If You Are Involved in an Accident (Dos and Don'ts)

Dos and Don'ts of on the scene How you conduct yourself at the scene of an accident can directly affect the outcome of later proceedings. No other consideration outweighs your legal and moral duty to get help for injured persons. Make this your first concern.

  • Don't move any injured persons - you must not risk aggravating their condition. Be comforting and encouraging. Your words and tone of voice could give them exactly the reassurance they need.
  • Don't say anything to anybody about who you feel was to blame for the accident. Even if you privately feel at fault, you words could be used against you later. Don't volunteer information.
  • Don't sigh anything except a traffic ticket (if you're given one). Don't sign other forms or papers that may be presented to you until you've consulted an attorney.
  • Don't move your vehicle. Call 911 to get help for anyone with an injury. Emergency services will be dispatched to the scene.

  • Do give the other driver(s) you name, address, phone number, and vehicle registration number. If you've collided with a parked car attach a note with this information to that vehicle. (If you simply take off, you may be committing a 'hit and run' crime.)
  • Do write down the particulars of the other driver(s) involved.
  • Do write down the statements and particulars of any witnesses.
  • Do sketch what happened.
  • Do write down what happened.
  • Do ask the investigating officer where you'll be able to obtain a copy of the accident report that will be filed. You might want a copy for insurance purposes.
  • Do notify you insurance company of the accident. They will supply you with their claim forms.
  • Do begin keeping accurate records of any time you take off work because of this accident. (See Recovering Lost Wages.)
  • Do file the mandatory "State of Nevada Motor Vehicle Crash Report*" with the Nevada Bureau of Motor Vehicles within 10 days after the accident.

      *This form needs to be completed:
    • When an accident was not investigated at the scene by law enforcement;
    • ONLY if damage occurred in excess of $750 to any on person or if the accident resulted in an injury or death;
    • Within 10 days of the accident.
