Recovering Lost Wages
What could an accident injury cost you in lost income? It could prove devastating if your claims for compensation aren't favorably received by the insurer.
Recovering Your Transportation Costs
As an accident victim you must not permit your situation to cause you economic disadvantage. Keep receipts for things like travel to and from the facilities you visit.
Auto Repair / Replacement
You can expect to have your vehicle restored to it's pre-accident condition unless the cost of repairs exceeds the pre-accident value of your vehicle. If the insurance company's estimate for repairs seems low, refuse it. If you don't like the insurer's choice of repair shop, find one that you trust instead. And, don't be pressured to sign a release.
If your vehicle needs to be replaced, the last thing you should do is simply take an insurer's word for its fair market value. Expect proper compensation. You'll be cheating yourself if you accept less.
According to the Insurance Research Council's own 1994 study, a person represented by an experienced attorney actually receives a much larger settlement amount (after attorney's fees) on average than someone not represented. |
Use of Car Rental
You need to minimize the inconvenience of having your car out of action. You may be entitled to a rental car of the same class and general quality of your car.
You may be entitled to the reasonable cost of a rental car used until your vehicle is repaired. If your vehicle is totaled you may be entitled to the reasonable cost of a rental car until the insurance company offers a reasonable settlement which may include sales taxes and registration fees.
